1. Acceptance of Terms
Welcome to Trackside Studio. These Terms and Conditions ("Terms") govern your use of the website tracksidestudioftl.com (the "Site") and the rehearsal studio rental services we provide (the "Services"). By accessing the Site, booking a session, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.
2. Eligibility
You must be at least 18 years old to book a session or enter into a contract with us. By using our Services, you represent that you meet this requirement. Minors may use the studio only under the supervision and responsibility of an adult who has booked the session.
3. Bookings and Appointments
Bookings are made through our Site using Square's appointment scheduling platform. By booking a session, you agree to the time, duration, and pricing displayed at the time of booking. We reserve the right to refuse or cancel bookings at our discretion.
Booking Confirmation: You will receive booking confirmations and access instructions via email and/or SMS text message. It is your responsibility to provide accurate contact information.
4. Payment Processing
All payments are processed through Square, Inc. By submitting payment, you agree to Square's terms of service and privacy policy. Trackside Studio does not store full payment card information.
Pricing: All prices are listed in U.S. Dollars and are subject to change. The price displayed at booking is the price you will be charged.
Cancellations and Refunds: Cancellation and refund policies will be communicated at the time of booking. No-shows and late cancellations may not be eligible for refunds.
5. SMS Notifications and Communications (Twilio)
- Trackside Studio uses Twilio and other messaging providers to send SMS text messages related to bookings, appointments, rehearsal reminders, setup instructions, customer support and account notifications.
- By providing your mobile phone number and opting in through our website, booking forms, or other communication channels, you expressly consent to receive SMS messages from Trackside Studio.
- Message frequency may vary depending on your interactions with our services.
- Message and data rates may apply.
- You may opt out of SMS communications at any time by replying STOP to any message. For assistance, reply HELP or contact us directly at 754-333-0367.
- Consent to receive SMS messages is not a condition of purchase.
- SMS consent is not shared with third parties or affiliates for marketing purposes.
- Opting out of SMS messages may affect your ability to receive booking confirmations, reminders, access instructions, or other service-related communications.
6. Studio Use and Rules
When using the studio, you agree to:
- Arrive at your scheduled time and vacate promptly at the end of your session
- Treat all equipment, instruments, and the facility with care and respect
- Follow all instructions provided regarding entry, setup, and closing procedures
- Turn off all amps, speakers, mixers, and lights before leaving
- Secure the facility (press the "home" button on the keypad) when departing
- Refrain from smoking, illegal drug use, or unlawful activity on the premises
- Respect neighboring units and keep noise within reasonable limits
- Not sublease, transfer, or share your booking with unauthorized parties
7. Damage and Liability
You are responsible for any damage to studio equipment, instruments, or property caused by you or your guests during your session. We reserve the right to charge the payment method on file for repair or replacement costs, plus reasonable administrative fees.
Assumption of Risk: Use of musical equipment, sound systems, and the studio facility is at your own risk. You acknowledge that loud music exposure may carry risks, including hearing damage, and you assume all such risks.
8. Limitation of Liability
To the fullest extent permitted by law, Trackside Studio, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Site or Services. Our total liability for any claim shall not exceed the amount you paid for the specific booking giving rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Trackside Studio, its owners, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another party.
10. Personal Property
Trackside Studio is not responsible for any personal property left at the studio or lost, stolen, or damaged on the premises. Please secure all personal belongings.
11. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Trackside Studio or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission. You retain ownership of any original musical content you create or record at the studio. We claim no rights to your original work.
12. Recording and Photography
You may record audio and video of your own performances during your session. You may not record other clients, staff, or areas of the facility outside your booked space without permission.
13. Prohibited Conduct
You agree not to:
- Use the Site or Services for any unlawful purpose
- Interfere with or disrupt the Site, servers, or networks
- Attempt to gain unauthorized access to any part of the Site or our systems
- Use the Site to harass, threaten, or harm others
- Misrepresent your identity or affiliation
14. Third-Party Services
Our Services rely on third-party providers, including Square (payments and bookings) and Twilio (SMS notifications). We are not responsible for the acts, omissions, or policies of these third parties. Your use of their services is subject to their respective terms and privacy policies.
15. Termination
We reserve the right to suspend or terminate your access to our Site or Services at any time, with or without cause or notice, including for violation of these Terms.
16. Disclaimer of Warranties
The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.
18. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on the Site with a revised "Last Updated" date. Your continued use of the Site or Services after changes constitutes acceptance of the revised Terms.
19. Severability
